How much does a family lawyer cost?
There is no honest national price list for family-law work. Fees depend on complexity, conflict, the forum and how much evidence the fight generates. Legal Aid can help some people; it is not a voucher for every case.

What drives the bill
- Whether you settle at FDR or run interim hearings.
- Valuations, subpoenas, and a family report.
- How many affidavits you write (and rewrite).
- Whether counsel (a barrister) is briefed.
- Your own email volume. Long midnight emails are a cost centre.
A joint divorce with a clean marriage certificate is a different product from a three-day parenting trial with a family report. A consent-order package is a different product from a company-valuation fight. If a stranger online quotes one number for “your whole matter,” they have not looked at your matter.
Ask for paper, not vibes
Australian solicitors provide costs disclosure. Read it. Ask what is in scope, what is a disbursement, and what happens if the other party files an interim application next month. Ask who will do the work. A partner’s rate on the website is not helpful if a junior will write every affidavit.
Legal Aid, CLCs and duty lawyers
National Legal Aid points to each commission. Community legal centres may give one-off advice. Court duty-lawyer schemes, where they exist, are for the day you are listed — not a continuing retainer. Ask what you are actually being offered.
Means tests look at income and assets. Merit tests look at whether the case is worth running under the commission’s guidelines. Family-violence and child-safety matters are often closer to the centre of those guidelines than a high-asset property argument between two people who can pay. A refusal is not a finding that you are being dramatic. It is a finding about a budget.
Court fees are a separate line
The FCFCOA and the Family Court of WA publish filing fees and reduction rules. Those pages change. This site will not invent a dollar figure. If money is tight, look at the fee-reduction material on the court site the same week you look at Legal Aid.

Private solicitors usually charge hourly rates plus counsel and expert fees if a case goes further. A consent-order package costs less than a three-day trial. Anyone advertising a guaranteed total for “your whole divorce” is not looking at your facts. Ask for a costs agreement and an estimate in writing.
How does Legal Aid work for family law?+
Each state and territory Legal Aid commission runs its own means test, merit test and guidelines. Some matters (especially those involving family violence or children at risk) are more likely to be in scope than a straightforward property split between two high-income earners. Apply early. A refusal is not a finding that you do not need advice.
Will the other person pay my costs?+
Family-law costs orders are not automatic. Each party often bears their own costs unless a statute or a specific conduct finding says otherwise. Do not run a case as a costs-harvesting exercise.
